Woobsy (operating via woobsy.com and PWA mobile clients) is an autonomous meta-marketplace search engine, product data aggregator, and AI shopping assistant. The platform indexes, analyzes, and compares public product offers across 42 global markets in real time.
Woobsy functions strictly as a search engine and technical comparison assistant. Clicking an offer directs the User directly to the independent third-party merchant's storefront. Any contract of sale is formed exclusively between the User and the external seller.
3.1. Woobsy, its Owner, and affiliates do NOT provide payment services, fiduciary custody, escrow accounts, money transmission, or any financial services under Directive (EU) 2015/2366 (PSD2) or equivalent banking regulations.
3.2. ZERO CUSTODY OF FUNDS: At no point do customer funds pass through or rest within Woobsy accounts. All payments flow directly and exclusively from the customer to the executing merchant or the merchant's certified payment processor.
3.3. Woobsy charges zero checkout fees or transaction deposits to users. Access to Woobsy search functionality is 100% free for consumers.
Pursuant to Articles 5, 6, and 8 of the EU Digital Services Act (DSA 2022/2065), Woobsy operates as an intermediary service provider (Non-MoR). Woobsy disclaims all liability regarding merchandise defects, delivery failures, merchant cancellations, and warranty fulfillment.
5.1. Woobsy is funded exclusively via commercial affiliate partnerships which pay referral commissions upon qualified visits or sales.
5.2. ZERO ADDED COST: Clicking an affiliate link never inflates the purchase price for the customer.
5.3. ALGORITHMIC NEUTRALITY: AI sorting and recommendations are determined strictly by semantic relevance, pricing, and stock status, never by affiliate commission rates.
Offers indexed by Woobsy may originate from professional traders or private individuals (C2C). When purchasing from private sellers, statutory consumer protection rights (including 14-day cooling-off withdrawal) do not apply.
In compliance with Articles 3 & 4 of Directive (EU) 2019/790, Woobsy performs Text and Data Mining (TDM) solely on lawfully accessible public web content, respecting robots.txt and HTTP metadata.
For cross-border shipments originating outside the User's customs territory, the User acts as the importer of record responsible for applicable duties, tariffs, and customs clearance.
Woobsy strictly enforces a total trade and routing embargo against the Russian Federation (RU), Belarus (BY), Iran, North Korea, and all sanctioned entities under EU, US OFAC, and UN international law.
These Terms of Service are governed by the laws of Poland and the European Union. Jurisdiction resides exclusively in the competent courts of Poland.
